Cancellation of Removal

Cancellation of Removal- The law allows certain people who have lived illegally in the U.S. for more than 10 years to obtain permanent legal residence, through a procedure known as cancellation of removal. It must be shown that their spouse or children-who are U.S. citizens or permanent residents would face “extraordinary and exceptionally unusual hardship” if the undocumented alien wasforced to leave the country. If you fall within this category, applying is difficult, because there is no regular process unless you are in deportation proceedings.

Registry – Another category that allows people to adjust status if they have lived in the United States since January 1, 1972.

Humanitarian- Individual members of Congress have on occasion, intervened for humanitarian reasons in extraordinary cases, helping an individual obtain permanent residence even if the law would not allow it. However, this is a last resort.
